It's a person's worst nightmare to be awoken by the sound of a trooper knocking on the door to say that the individual's spouse, parent or child is never coming home again. Sadly, this is the tragic reality for many in New York after fatal car accidents. One such fatal accident recently occurred that took the life of one individual while seriously injuring another.
The incident occurred in the neighborhood of South Ozone Park, Queens, New York City on a recent Sunday afternoon in July. The crash killed a 41-year-old mother, while her 9-year-old daughter was critically injured. The other driver is now facing charges, including manslaughter, assault, criminally negligent homicide, leaving the scene of an accident, and the unlicensed operation of a car.
The deceased woman's husband's vehicle was going through an intersection when he said he saw a car rapidly approaching but knew it would be impossible to get out of the way in time due to the other vehicle's high rate of speed. The car blew through the stop sign and slammed into the first vehicle's passenger side, causing the mother and daughter to be ejected. Apparently the other car's driver had been seen speeding and crossing the road's double-yellow line to illegally pass other vehicles before the collision occurred, officials said. The man -- who fled from the crash on foot, leaving a 46-year-old passenger behind -- was driving on a suspended license and was going more than double the posted 25 mph speed limit.
When a loved one's serious injury or death results from the negligence, intentional, or sheer reckless action of another person, the deceased's family or loved ones may have an avenue for compensation for their loss, as well as a way to secure the family's financial future during a devastating time in their lives. Individuals may be able to make a claim to recover compensation for funeral expenses, lost wages the loved one would have contributed to their family and medical bills related to the loved one's treatment for injuries suffered in the accident. An experienced personal injury attorney is often consulted to help with the claims process.
