Public officials in New York City have noticed that pedestrian safety has become a major issue over the last year. Many drivers are failing to yield at crosswalks, which has put pedestrians at risk of serious or fatal injuries. Mayor De Blasio has suggested increased safety measures and reduced speed limits in areas heavily trafficked by pedestrians.
One of the most recent car-pedestrian accidents is a stark reminder that drivers need to be more attentive at crosswalks and intersections. According to a report in the New York Times, a 9-year-old boy was walking across the street with his father, a renowned oncologist, when a taxi crashed into both of them.
As the taxi driver attempted to make a left-hand turn, he failed to stop for the father and son who were in the crosswalk. The father suffered a leg injury. Unfortunately, his son sustained much more serious injuries. First responders rushed the young boy to a hospital, but efforts to save his life were unsuccessful.
Even though the 9-year-old boy lived only a short time, he touched many people’s lives. His loved ones remember him for his energy, intelligence and love for Yankees baseball. As the young boy’s family misses out on time spent with him, they may consider their legal options to file a wrongful death claim to help recover some of their losses.
In addition to holding the specific driver accountable in civil court, it may also be possible to include the cab company in a suit. Through the legal doctrine of vicarious liability, employers of commercial drivers can also be held liable, depending on the circumstances behind the accident. This can help accident victims’ loved begin to feel whole once again.
