Will texting drivers soon have to worry about the Textalyzer?

Even though most states, including New York, have laws that prohibit texting while driving, people still do it - thereby putting themselves and everyone else on the road at risk. The situation is made even worse by the fact that it is often difficult for police to enforce the laws already on the books.

Insurance payouts for dog bites increase. Are homeowners always legally responsible?

According to data released earlier this year by the Insurance Information Institute (III), the average homeowners' insurance payout for dog-bite claims was $37,214 in 2015 - a 16 percent increase from the year before, and an astonishing 94 percent increase from 2003. In fact, dog bites and other dog-related injuries now account for a whopping one-third of all dollars paid in homeowners' insurance liability claims, according to the III report.

Filing a Wrongful Death Action

It is devastating to lose a loved one. It can be particularly traumatizing when their death was caused by the wrongful conduct of another. Recently, there has been much news coverage of families who have filed wrongful death lawsuits. In one New York case, a family recently filed suit for $20 million in damages for the loss of their son who spent over two years at Riker's Island without a trial. In that case, the young man was arrested and held in jail where he began to suffer psychological turmoil. The charges against him were eventually dropped, but he continued to suffer from the devastating effects of incarceration and later committed suicide in his home. The suit alleges that the young man was maliciously prosecuted, denied his constitutional rights, and was inhumanely and cruelly punished by the city in addition to being subjected to mental and physical abuse by the city's corrections officers.

Supermarkets Across the City Receive Health Code Violations

Across the five boroughs of New York City and Long Island, nearly a thousand grocery stores received health violations for conditions found between May 15, 2014 and June 5, 2015. In New York City alone, 847 grocery stores were cited for violating health codes. 56% of those stores received ten violations or more. The stores cited with violations ranged from gas station marts to the less expected upscale food markets.

Shark Recalls Motorcycle Helmets for Not Complying with Safety Standards

With the weather getting warmer, many people like to spend time outdoors. This also means many more motorcycles are on the road. As a motorcyclist, safety is imperative. New York and New Jersey state laws require the use of helmets for both drivers and passengers to avoid fatalities or serious head injuries in the event that an accident should occur. In fact, nearly 5,000 motorcyclists were killed nationwide in 2012.

What is primary assumption of risk?

Recently, a Long Island school district failed to convince an appellate court to dismiss a personal injury suit stemming from a minor's midnight tumble down a school stairway while he was playing with friends, unaccompanied by school officials, on school grounds.

In NYC, neglected tree maintenance raises city's liability costs

It has been said that an ounce of prevention is worth a pound of cure. In other words, spending a little time/effort/money to prevent a problem is much cheaper than the time/effort/money required to fix a problem that has already occurred.
